Terms of Service

By installing or using the ScanSmart application ("the App"), you agree to these terms. Please read them. If you do not agree, do not install or continue to use the App.

1. The service

ScanSmart provides on-device document scanning, optical character recognition (OCR), local document management, and optional cloud backup for registered users (collectively, "the Service"). We may add, change, or remove features at any time.

2. Your account

You can use the App in Guest mode without an account. Some features require you to register with an email and password, or sign in with a supported third-party provider (currently Google). You agree to:

• provide accurate registration information;
• keep your password and access tokens confidential;
• be responsible for all activity that occurs under your account;
• notify us promptly at support@scansmart.app if you suspect unauthorized access.

You may close your account at any time from Settings → Account → Delete Account. See the Privacy Policy for what happens to your data when you do.

3. Your content

Everything you scan, type, or upload through the App (your "Content") stays yours. We do not claim ownership of your Content.

To run the Service, you grant us a limited, worldwide, royalty-free license to host, store, transmit, and display your Content solely as needed to operate ScanSmart on your behalf — for example, to back up your scans or render them across your devices. We do not use your Content for advertising, training machine-learning models, or any other purpose.

4. Acceptable use

You agree not to use the App to:

• break any law, including by scanning or distributing materials you don't have the right to use;
• infringe anyone's intellectual-property, privacy, or publicity rights;
• upload malware, harmful code, or unlawful content (e.g. child sexual abuse material, terrorist content);
• attempt to gain unauthorized access to the Service, other users' accounts, or our infrastructure;
• probe, scan, or load-test the Service without our prior written consent;
• resell, sublicense, or commercially redistribute the App without our written permission.

We may suspend or terminate accounts that we reasonably believe are in violation of these terms.

5. Subscriptions and purchases

The current version of ScanSmart is free. If we introduce paid features (for example, the planned "ScanSmart Pro" tier), pricing, billing terms, and refund policy will be presented inside the App at the point of purchase and will be governed by the Google Play Store's payment terms in addition to these Terms.

6. Third-party services

The App relies on third-party services described in the Privacy Policy (Google, Render, Cloudinary, Resend). Their own terms apply to your use of those underlying services. We are not responsible for outages or changes in those third-party services, but we will do our best to keep ScanSmart working around them.

7. Intellectual property

The App, our trademarks, and the ScanSmart brand are our property. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for personal or internal business purposes. No other rights are granted.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT OCR RESULTS WILL BE ACCURATE FOR YOUR USE CASE.

ScanSmart is a tool, not a legal record-keeping service. Do not rely on it alone for legal, tax, accounting, or medical purposes — keep your original documents.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, fraud or gross negligence in jurisdictions that prohibit such waivers).

10. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the Service if you materially violate these Terms or if we reasonably believe your use creates risk for us or other users. Sections that by their nature should survive (ownership, disclaimers, limitations of liability, governing law) will survive termination.

11. Changes

We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, will give you reasonable advance notice in-app or by email. If you continue using the App after a change takes effect, you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Romania, without regard to its conflict-of-law principles. You and we agree to the exclusive jurisdiction of the courts located in Cluj-Napoca, Romania, except where this would conflict with your mandatory local consumer-protection rights, in which case those rights apply instead.
